ON THE PROSPECTS FOR IMPROVING CUSTOMS REGULATION IN THE EAEU

On December 23, 2022, the XI International Scientific and Practical Conference of the Faculty of Law of the Russian Customs Academy «Issues and Prospects for the Development of Modern Legislation» was held.

Participants of the event: scientific and pedagogical staff of the Russian Customs Academy, educational organizations and scientific institutions of the Russian Federation, the Republic of Kazakhstan, the Republic of Uzbekistan, the Republic of Belarus, doctoral students, graduate students, undergraduates, students of the Law faculty, practitioners of the Federal Customs Service and the Eurasian Economic Commission (EEC).

Sergei Mozer, Deputy Head of the Division of Advanced Customs Technologies of the Department of Customs Legislation and Law Enforcement Practice of the Eurasian Economic Commission addressed the conference participants with a welcoming speech.

He thanked the leadership of the Academy for the invitation to take part in the scientific conference and noted that the cooperation between the EEC and the Russian Customs Academy has been carried out for many years. Representatives of the Customs Cooperation Bloc of the EEC participate in scientific and practical events of the academy and research projects, conduct open lectures for students of the academy, and also take part in the work of the Examination Committee when graduating students and graduate students. Hope was expressed for continued interaction between the EEC and the Academy.

As part of the event, Sergei Mozer presented a report on the topic «On the prospects for improving customs regulation in the Eurasian Economic Union in the current conditions of the development of Eurasian integration».

In his speech, he raised the issue of developing a new strategic planning document that sets the main vectors for further integration cooperation in the Union in the medium and long term for the development of customs regulation, for example, until 2040.

To date, the only document that consolidates the directions for improving customs regulation within the framework of the EAEU is the Strategic Directions for the Development of Eurasian Economic Integration until 2025 (Strategic Directions). However, according to the speaker, they do not contain basic guidelines for the development of customs regulation in the Eurasian Economic Union (EAEU) in the context of customs law institutions or elements of the customs administration system, including taking into account national concepts for the development of customs regulation in the Member States of the Union.

The conference participant stated the absence of fundamental scientific works, as well as serious analytical materials on the subject of improving customs regulation in the Union in the near future, as well as strategic documents that, in a complex, accumulate promising directions for the development of legal norms and instruments of the Union in the customs sphere.

The representative of the Commission dwelled on the case study of the bloc on customs cooperation of the Commission, which was carried out in 2020 in order to identify promising areas for the development of customs regulation in the Union. Along with this, he touched upon the Strategy for the activities of the bloc on customs cooperation of the EEC until 2025, and also spoke about possible directions and prospects for improving customs regulation in the Eurasian Economic Union in the current conditions of the development of Eurasian integration.

The author of the report paid special attention to the implementation of paragraph 11.7.5 of the Strategic Directions in terms of cooperation with the WCO. The speaker drew attention to the fact that the scientific works of the Russian Customs Academy «Legal Instruments and Tools of the WCO», as well as «Legal and organizational basis for economic and customs unions to get the status of member of the World Customs Organization» covered the mentioned paragraph 11.7.5 and can be used in expert work of the Working Group on Interaction with the WCO, established by the Order of the EEC Board dated March 29, 2022 № 55.

 also added that the scientific research of the Academy is located in the library at the WCO Headquarters and is of interest to the technical specialists of this international organization.

The EEC representative also added that the academy’s scientific monographs on topical issues of the WCO work are in the library at the headquarters of this international customs organization and is of interest to its technical specialists.

At the end of the speech, the speaker emphasized that the theses voiced are his private point of view and are not associated with his professional activities.
